Forward Thinking Dog Training Terms and Conditions
When we say:
we, us and our – we mean Forward Thinking Dog Training and Mobility and its employees or agents
you and your – we mean you as the participant in dog training services provided by Forward Thinking Dog Training and Mobility
Activity – we mean the dog training and associated mobility services that we provide
person – we mean an individual, a partnership and anybody whether incorporated or not.
How these terms and conditions apply
These terms and conditions apply to your current participation in the dog training and associated mobility services provided by Forward Thinking Dog Training and Mobility (“the Activity”).
These terms and conditions and your participation in the Activity are governed by the laws in force in South Australia.
Your obligations as a Participant
1.Your commitment to us
You will:
abide by our Code of Conduct available online on our website and will comply with any sanctions imposed as a result of your breach of the Code of Conduct, including but not limited to cancellation of the Activity and being liable for the full cost of your registration
comply with all rules and conditions set by our venues and follow our reasonable directions in the course of participating in the Activity
inform us in writing at least two (2) working days prior to the Activity if you are no longer able to participate in the Activity otherwise you remain liable for the full cost of your registration
inform us of any medical conditions, allergies, food restrictions or any other special needs your dog may have prior to undertaking the Activity
give us permission to administer appropriate first aid if your dog requires first aid
inform us of the details of your pet’s insurance and/or consent to us obtaining for you on your behalf at your expense any emergency medical assistance, treatment and transport as deemed reasonably necessary by us for your dog in an emergency
consent to us using your dog’s photograph and/or comments and/or a video recording of your dog in print, broadcast, online and social media free of charge
advise us prior to the Activity if you do not wish to have footage or photography taken of your dog for any purpose associated with the Activity.
2. Breach of terms and conditions
If you breach any of these terms and conditions, you must immediately:
advise us of that breach
stop participating in the Activity until we advise you can.
A breach of these terms and conditions may result in one or more of the following actions:
a direction to change your conduct
suspending your participation in the Activity
terminating your participation in the Activity
and you remaining liable for the full cost of your registration.
3. Responsibility for actions
You will be responsible for (and you indemnify us against) any loss or damage to any person or animal from either any:
any breakages or injury arising as a result of your dog’s behaviour
wilful, negligent or unlawful act or omission by you in relation to, or in the course of participating in the Activity
breach by you of these terms and conditions
any other claim, loss, demand, cause of action, cost or liability (including reasonable legal fees and expenses) which may be asserted against or incurred by us as a result of your participation in the Activity.
However, your liability to us will be reduced to the extent that any wilful, negligent or unlawful act or omission by us has contributed to that loss or damage.
Our obligations
Our commitment to you
Private lessons are provided on a lesson-by-lesson basis, the goal being to teach you (and/or your household) how to train and work with your dog. These lessons will take place at your home or in the local area (“the Activity”).
We will:
carry out the Activity as advertised within a reasonable time using an acceptable level of skill and/or technical knowledge
take reasonable steps to avoid loss or damage when providing the Activity.
We will make every reasonable effort to help you achieve training and behaviour modification goals but make no guarantee of your dog’s performance or behaviour as a result of providing professional animal behaviour consultation. For best results, you will follow training advice and maintain the dog’s behaviours with ongoing training and reinforcement.
2. Fees and Cancellations
Our fees may be subject to change.
Additional travel fees may apply, and we will inform you prior to the Activity of any additional fees.
Training packages are valid for 6 months from the date of purchase. We are not obliged to refund you the unused portion of the training package if you do not complete all your sessions within the 6-month period except to the extent permitted by the law.
We are not obliged to refund you if you:
change your mind and cancel the Activity
fail to inform us in writing at least two (2) working days prior to the Activity if you are no longer able to participate in the Activity
fail to attend at the time of the scheduled Activity
commence the Activity and unable to complete it
insist on having the Activity provided in a particular way against our advice
fail to clearly explain your needs to us before commencing the Activity
breach our terms and conditions or Code of Conduct
except to the full extent permitted by the law.
We may be required to alter or cancel the Activity without notice if:
there are unforeseen circumstances outside of our control
your dog is a risk to us or any other person or animal or interferes with the training of other dogs.
We will not be liable for any losses arising from a cancelled, delayed or rescheduled Activity except to the extent permitted by the law.
Privacy and secrecy obligations
We will ensure that we comply with applicable privacy and health records legislation at all times when we collect and store your personal information.
We will not share your personal information with any third parties.
If making a referral we will seek your permission before sharing any of your information.
Any keys will be tagged with non-identifying details, stored securely, and returned to you upon discontinuation of the Activity.
Limited liability
We will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages (including for loss of profits, goodwill, information, data or other intangible losses) resulting from your participation (or the inability to participate) in the Activity.
No Guarantees by us
We will make every reasonable effort to help you achieve training and behaviour modification goals but make no guarantee of your dog’s performance or behaviour as a result of providing professional animal behaviour consultation.
In particular, we do not promise or guarantee that your dog will:
never bite
not be dangerous in the future
not exhibit other behavioural problems.
We do not guarantee that the results of the Activity will last for any particular length of time.
For best results, you will follow training advice and maintain the dog’s behaviours with ongoing training and reinforcement.
No warranties by us
Except as specified in these terms and conditions, we give no implied or express warranties in relation to your participation in the Activity. All statutory warranties are, to the fullest extent permitted by law, expressly excluded.
Our rights
We can:
limit your ability to participate in the Activity
terminate your Activity at any time in accordance with these term and conditions
work out the times and periods in which the Activity takes place
vary the terms and conditions of the Activity (so the terms and conditions applicable when you next participate in the Activity may be different from these terms and conditions)
use the footage of your dog taken within your home or local area and shared with yourself to support the training. We may also share this on our social media using the name of your dog but will not disclose any other identifying information.
